After expungement: privacy and fast removal for renters

When the court grants expungement, it sets aside any judgment and orders the record removed. After the order, the case is treated as if it was never filed, and you may say it did not happen. Within 45 days, the court sends you written notice and a certified copy, and removes the record from public court systems. Expunged records are shared only with the Department of Justice (kept confidential), with you, or in redacted form without your name, personal info, or the property’s address. These rules take effect six months after enactment.

Easier to clear eviction records for renters

The Justice of the Peace Court automatically expunges an eviction case if the landlord withdraws, the court dismisses, or you win. You can also file a motion to expunge. The court must grant it if one is true: at least 5 years have passed since judgment and you paid any money owed; you followed a settlement; both sides agree; or it is clearly in the interests of justice. There is no filing fee for this motion. These rules take effect six months after enactment.
