New rules for pharmacy reverse auctions

Reverse auctions happen online. All bidders see prices in real time, but bidder names stay hidden during bidding. Bidders can lower their prices until the auction ends. The Section may use a reverse auction only when it is advantageous and its director, or a designee, gives written approval. Before bidding, vendors must preregister so the state can check responsibility and require acceptance of terms. The solicitation must say a reverse auction will be used, share the schedule, and include the procedures. The Section or an agency may hire a third party to run the auction with written approval. Each proposal must list the vendor’s name and address. Proposals and evaluations stay confidential until after a contract is signed. After that, they are open to public inspection.

Reverse auctions only for state pharmacy services

The law limits reverse auctions to one area. They apply only when the State Employee Benefits Committee buys professional services for or related to pharmaceuticals or pharmacy benefit management. Other state contracts do not use reverse auctions under this law.
