Stronger watchdog for nursing and assisted living

The Commission now oversees care, safety, and quality in nursing facilities, assisted living, and secured memory care units. It reviews policies, tracks data and trends, visits facilities, and makes recommendations to state leaders. It protects resident privacy and publishes a yearly public report with data, findings, and next steps. All duties and authorities start 90 days after enactment.

How the Commission runs its meetings

The Commission meets at least four times a year. Virtual meetings are allowed with a public anchor location. Members elect a Chair. A majority of current members present makes a quorum, and motions pass by a majority of those present; vacant seats do not count. The Commission may adopt bylaws, and can form subcommittees, hear outside testimony, and let subcommittees act within its purpose.

Staff, funding, and legal support

An Executive Director and staff run the Commission’s daily work and may speak for it within its purpose. Staffing depends on the annual state budget and any grants the Commission secures. The Department of Justice provides legal advice.

Who serves on the protection commission

The Commission includes ex officio seats for the Attorney General and leaders from legal aid, provider groups, and aging and Alzheimer’s advocacy. The Governor appoints seven members: a resident or family member, three workers (one per county), a health‑care professional, and two advocates. Four more members are chosen by Commission vote: a resident or family member, two advocates, and a health‑care professional. Designees must come from the same organization. Members serve three‑year terms (staggering allowed) and lose their seat after three missed meetings in a row or four of any 12. The law requires representation from all three counties.

Commission members unpaid, expenses covered

Commission members do not receive pay. They can be reimbursed for reasonable, necessary expenses tied to their duties.
