Independent drug list for state health plans

The law creates an independent Pharmacy and Therapeutics committee for the state plans. It sets and reviews the drug list for state employees and retirees. The consultant who advises the list is paid to find the lowest-cost options. They must recommend generics when there is no added benefit from a brand drug. This helps control plan costs and can lower what you pay at the pharmacy.

Stronger drug price bargaining for state plans

The law requires active price bargaining for state drug coverage. The SEBC uses tools like reverse auctions and other supply-chain tactics to cut costs. PBMs must bid using the lowest available price for each drug, not the average wholesale price. The State does not pay more than Medicare’s negotiated price when Medicare has one. Delaware can also join other states to negotiate directly with drug makers for very expensive medicines.

More PBM transparency and audits for state plans

The law gives the State stronger oversight of drug spending. The State owns and uses real-time point-of-sale drug price data. PBMs that work with the State must disclose all their administrative fees. The SEBC can see PBM contracts with drug makers for covered drugs. The State can audit these records and hire outside auditors to check for overcharges.
