Renters can shield eviction records

As a renter sued for eviction in Delaware, you can ask the court to shield the case record. The court must grant it if, for example, the case was dismissed, the landlord withdrew, you won, both sides agree, or you followed a settlement. It also applies if a judgment is at least 5 years old, you paid what you owed, and you have no similar judgments within 5 years, or if justice clearly calls for it. If granted, the court shields the record, sets aside any judgment, and you may answer as if the case never happened. There is no filing fee to make this request. The law applies beginning six months after enactment.

Courts must hide shielded eviction cases

When a case is shielded, the court has 45 days to send you written notice and a certified copy. The court must remove the case from public court systems and store files so the public cannot access them. Shielded records can be shared only with the Department of Justice (kept confidential), with you, or by court-approved limited release with names, personal details, and the property address removed. The court can set rules and forms to run this process.
