Bill Overview

Analyzed Economic Effects

4 provisions identified: 0 benefits, 1 costs, 3 mixed.

Condo grants fund only qualifying upgrades

Grants cover water-intrusion protection or hurricane upgrades, but funded work must earn the building an insurance credit, discount, or other rate difference. Inspection-recommended work includes protection for exterior doors, garage doors, windows, and skylights; roof-to-wall reinforcement; stronger roof-deck attachments; secondary water resistance; and roof-covering replacement. Every funded improvement must appear in the final hurricane mitigation inspection. For property already meeting applicable code when applying, upgrades must meet or exceed current code and provide greater hurricane protection. The department must require upgrades to all openings when needed for the building to qualify for the insurance benefit.

State matches condo hurricane repair costs

The law establishes the My Safe Florida Condominium Pilot Program within Florida's Department of Financial Services. The state provides $2 for every $1 an association contributes toward actual project costs, up to $175,000 per association per grant cycle. This replaces separate roof and opening-protection formulas and per-unit caps. Help depends on annual legislative funding and is not guaranteed; without express legislative permission, applications and waiting lists close once awards commit all available money. The department oversees spending and contracts, and the law takes effect upon becoming law.

Condo hurricane aid has eligibility limits

Program inspections and grants are limited to buildings on condominium property that are at least three stories tall. A building receiving a grant must contain at least two single-family dwellings; detached units on individual land parcels are excluded. Associations must meet existing inspection requirements before applying for either an inspection or a grant. For grants covering association or condominium property, the condominium declaration must list windows as common elements, meaning shared property.

Condo unit grants need fewer approvals

For grants improving individual units, approval from 75% of owners living in the affected building replaces unanimous approval. Associations also need a majority of the board or total voting interests to approve inspection participation. That majority vote is also required to apply for inspections or grants covering association or condominium property. Grant applications require the president's statement, under penalty of perjury, confirming only one application per property, plus notarized contractor names and license numbers. They also require a notarized commitment to finish the work and, for unit improvements, acknowledged statements from each owner whose approval is required.
