Bermont landowners face possible maintenance taxes

Bermont Drainage District can levy a maintenance tax on assessed land, including parcels smaller than one acre. The tax must be equal and uniform per assessed acre and also applies to each parcel under one acre. The law sets no tax rate or amount owed. State laws govern district borrowing, financing, and collection of assessments not based on property value, fees, and service charges. The law took effect upon becoming law and applies retroactively to March 12, 2025.

Bermont landowners elect the district board

The law confirms Bermont Drainage District as an independent water control district and Florida public corporation with state-law powers. It confirms the March 12, 1965, court decree and related proceedings, covering 2,900.24 acres in Charlotte County. Landowners elect three supervisors who must own district land, live in Florida, and be U.S. citizens. Votes use each owner's combined acreage: one per acre, plus one for a remaining fraction greater than one-half acre. Owners with less than one acre get one vote total. At annual and special meetings, landowners attending or represented by proxy form the quorum, with no minimum attendance specified. Only a special act of the Florida Legislature can change the charter. State laws govern financial disclosure, meeting notices, public records, reporting, planning, board pay, and administrative duties. The law took effect upon becoming law and applies retroactively to March 12, 2025.
