Starting July 1, 2026, state agencies must check the national sex-offender website before hiring or appointing people at parks, pools, day cares, and similar sites. If the national site is unavailable, they must use the Florida registry. This step is not needed when a full state and national background check is already done.
The law bans certain sex offenders from living within 1,000 feet of a school, child care, park, playground, or public pool. It applies when the victim was under 16 and the crime happened on or after July 1, 2026. It also covers listed Florida crimes from Oct 1, 2004 to before July 1, 2026, and similar out of state crimes from May 26, 2010 to before July 1, 2026. If a covered site opens later within 1,000 feet, the person does not have to move. Violations carry penalties based on the level of the earlier conviction.
Beginning July 1, 2026, added rules apply to supervised people convicted of listed sexual crimes against minors. They may not live within 1,000 feet of any public swimming pool. They do not have to move if a pool opens later nearby. They may not work for pay or volunteer at a public pool. In some cases, they may not visit a public pool without prior approval from their supervising officer, unless a pardon or set-aside applies.
Beginning July 1, 2026, the law defines a public swimming pool. It covers indoor and outdoor pools and the area around them. It includes spa pools, wading pools, splash pads, spray pools, and other water attractions. It also covers pools run by parks, schools, apartments, condos, mobile home parks, townhouses, or government. It excludes private single-family pools and pools that bar people under 18.
The law tightens rules for certain offenders in places where children gather. Loitering is now an offense within 300 feet, down from 500 feet. Covered people may not approach or contact anyone under 18 in a public park, playground, or public pool. They may be at a school or child care only if they give written notice, check in and out, and stay under direct supervision. Exceptions allow voting, dropping off or picking up your own child, or attending a religious service. Police may arrest without a warrant when there is probable cause of these violations, starting July 1, 2026.
