Felony ban on silencers and automatic guns

The law makes it a felony to make, sell, give, transfer, buy, or have certain guns and silencers in Guam. Banned items include machine guns, sub-machine guns, automatic rifles; rifles with barrels under 16 inches; shotguns with barrels under 18 inches; pistols or revolvers with barrels 12 inches or less; and any muffler or silencer. A conviction brings at least 3 years in prison and at least a $1,000 fine. No parole, probation, work release, or a suspended sentence is allowed until the prison term is served.

Lighter sentences for first-time banned-gun cases

If you have no prior felony conviction, the court can set your sentence at no more than 2 years for an offense under this section. In these cases, probation, parole, work release, and a suspended sentence are allowed.

Silencers allowed only under federal rules

If you qualify under Guam’s gun rules, you may own and carry rifles, shotguns, pistols, or revolvers that are not banned. A silencer is allowed only if its design, purchase, ownership, and possession follow federal law. This applies only where Guam’s prohibited-weapons rules do not ban the device.
