Legal protection for unpaid emergency helpers

If you give emergency help in good faith and are not paid, you are not liable for civil damages. This covers aid at an accident, fire, or other life‑threatening emergency, and while on the way to care. If you finished a CPR course approved by the Department of Public Health and Social Services’ Office of Emergency Medical Services, you are deemed qualified to give CPR, use a defibrillator, or other approved lifesaving care. You are protected from civil suits for acts or omissions while giving that unpaid, good‑faith aid.

Protection for EMTs and emergency birth care

Certified emergency medical attendants and technicians with a valid Public Health EMS certificate are not liable for civil damages when they give unpaid, good‑faith emergency care. This protection applies at a scene, by phone, or during transport, even if some DPHSS or local rules are not followed in the emergency. People or health care providers who give unpaid emergency obstetrical care to a woman in active labor are also protected. This birth‑care immunity applies only if there is no gross negligence, the provider had not cared for her in this pregnancy, and her medical records were not reasonably available.
