Brokerage contracts must include clear terms on pay, timing, and cancellation. For sellers or landlords, the contract must show a firm start and end date that take effect without more notice. It must state the broker’s pay, if others can pay or share it, when a commission is earned, and how either side can cancel. For buyers or renters, the contract must show start and end dates. It must state the broker’s pay, if someone else may pay some or all of it, your rights and duties about that pay, when a commission is earned, and how either side can cancel.
The law requires a written agreement with a licensed real estate broker or salesperson before services start. The broker must give you a signed copy within three (3) business days of signing. The brokerage must keep the original agreement and all electronic files.
