Beginning July 1, 2025, Idaho residential property owners or authorized agents can request sheriff removal of people who unlawfully entered and remain. The property must not have been open to the public when they entered, and the owner must have told them to leave. This process excludes current or former owner-authorized tenants, the owner's immediate family, and cases with pending litigation between the owner and a known occupant. Owners must submit the required complaint confirming eligibility; false statements can bring liability. The sheriff must verify ownership or authority, serve notice to leave immediately, and return possession to the owner. Notice can be delivered by hand or posted at the home. Owners can request sheriff standby while changing locks and moving belongings to or near the property line. The sheriff may charge a possession-order service fee and a reasonable hourly standby fee, paid by the requester. Owners and agents are not liable for occupants' losses unless removal was wrongful. Anyone harmed by wrongful removal can seek restored possession, actual costs and damages, and statutory damages of three times the home's fair-market rent. They can also seek court costs and reasonable attorney's fees, and courts must give these cases priority. Existing owner rights and law enforcement's arrest powers remain in place.
Beginning July 1, 2025, Idaho law creates crimes targeting false property documents and fraudulent home sales and rentals. Knowingly and willfully presenting a false lease, deed, or similar document to hold or remain on property is a misdemeanor. Listing or advertising a home for sale is a felony when the person knows the seller lacks title or authority to sell. Renting or leasing a home is also a felony when the person knows they lack lawful ownership or a leasehold interest. These rules protect owners, buyers, and renters, while adding criminal penalties for those acts; the provisions state no dollar penalties.
