2 provisions identified: 1 benefits, 0 costs, 1 mixed.
Beginning January 1, 2027, insurers must give written notice when making an unconditional payment on certain homeowners insurance claims. This applies to claims under dwelling coverage or other structures coverage. The notice must explain that the payment does not stop, pause, or extend the deadline to sue.
The law covers insurance issued for delivery in Louisiana covering people or property in the state. It also covers health and accident policies insuring Louisiana residents, regardless of where issued. For first-party claims under R.S. 22:47(6), (10)–(13), (15), and (19), contracts must allow at least 24 months from the loss to sue. For other insurance, contracts must allow at least one year after the legal claim arises, unless the Insurance Code provides otherwise. Payments under the listed policy types do not count as acknowledging a debt or extend the contract’s lawsuit deadline, which runs from the loss.
