More coordinated care for emergency mental-health patients

The law covers patients admitted to Louisiana facilities for inpatient behavioral health care under an emergency certificate. Within 72 hours of admission, a licensed healthcare professional must evaluate the patient to identify underlying behavioral health conditions. The facility must also contact the patient’s known primary or behavioral health provider within 72 hours to learn their treatment history. Discharge planners must make reasonable efforts to coordinate ongoing care and provide appropriate prescriptions. This includes notifying current care providers of the discharge date and time, unless the patient objects. Patients without a current care provider must receive referrals for behavioral health and primary care. Follow-up providers must be notified within 24 hours after discharge and receive a medical-history and current-condition summary by the scheduled follow-up date. Discharge efforts also include giving patients state educational materials before or at discharge. The Louisiana Department of Health must publish these materials for patients and their families, caregivers, or friends. They must explain self-harm warning signs, the importance of continued care, and how to seek professional help. They must also explain that privacy laws do not prevent loved ones from telling treating professionals about the patient’s condition.
