Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 1 costs, 1 mixed.

Stronger protections against misleading insurance claims

An insurer or its representative breaks the insurer’s good-faith duty by knowingly misstating relevant policy terms. The law expands the listed misconduct beyond misstatements about facts or policy terms tied to the coverage at issue. This strengthens protections for people handling insurance claims.

New limits on insurance claim lawsuits

These good-faith rules limit injury-claim lawsuits against insurers by insured people or those holding their claim rights. They create no right to sue when there is a good-faith dispute over fault or the injury’s medical cause. This limit also applies when no offer within policy limits is presented by or for a third-party claimant and the insurer has at least 30 days to respond. The rules also create no separate right to sue an insurer’s representative apart from the insurer itself. These limits concern lawsuits under these good-faith rules, not every possible legal claim.

Contractor license checks can delay repair payments

Covered insurers must pay claims within 30 days after receiving satisfactory proof of loss, subject to applicable statutory exceptions. Policies excluded by R.S. 22:1811, 22:1821, and Chapter 10 of Title 23 are outside this rule. Insurers must notify the insurance producer of record about property-damage payments. Before issuing a repair or restoration check naming a contractor, the insurer or adjuster must verify the contractor’s license. This applies to immovable property, such as buildings, and uses the Louisiana State Licensing Board for Contractors’ website or portal. Delays directly and reasonably caused by failed verification are protected from bad-faith findings, penalties, and attorney fees. The insurer must record the attempt’s date, time, and result in the claim file. It must also notify the insured in writing within five business days that payment is delayed pending license verification.
