Louisiana's Coastal Protection and Restoration Authority can use flexible construction contracts for coastal protection projects and related work. It must find that using these contracts serves the public interest. One contractor can be selected by lowest bid or best value. Multiple contractors are selected by qualifications, with work orders going to the lowest responsive bidder. Initial contracts last no more than five years; extensions can add five years, with a ten-year total limit. Procurement rules cover advertising, notices, proposals, qualifications, and bid security, which the authority can waive. Documents must explain startup and shutdown costs, reimbursement, price increases and decreases, work-item pricing, minimum annual service values, and selection procedures. They must also include special contract terms. The authority can buy project materials separately. A work order alone does not authorize construction to start. Performance bonds generally cover each work order, rather than the full contract; agreed damages also apply by work order. The authority sets insurance requirements. Design-build contracts and most architect, engineer, and consulting contracts are excluded, but architect and engineer services supporting construction are allowed. Other state contracting laws still apply unless this law overrides them; conflicting federal requirements control. The authority can issue implementing rules under the Administrative Procedure Act. The law specifies no project funding or household payment.
For these coastal construction contracts, proposals, qualification statements, evaluation records, and related procurement information stay closed to public inspection. This restriction lasts until the authority enters into a contract or cancels the procurement. Evaluation committee meetings are exempt from Louisiana's Open Meetings Law.
