The law protects voluntary parent groups teaching children across multiple grade levels at agreed times. These microschools meet in homes, libraries, community spaces, learning centers, or similar settings for part or all of the school week. Using, renting, leasing, or lawfully possessing a building for a microschool does not change its zoning or occupancy classification. Microschool use alone cannot trigger extra building-code or fire-safety rules. The building must still meet occupancy requirements for its existing classification.
Qualifying microschools are voluntary parent groups teaching children across multiple grade levels at agreed times in nontraditional settings. Children participate for part or all of the school week. Government agencies cannot deny or restrict building use for these or similar educational activities, regardless of day, time, or hours. Agencies cannot require compliance with the Title 17 education rules cited in the law for that use. They also cannot require these microschools to register or report. The specified state licensing requirements do not apply to qualifying microschools or covered religious education activities.
