Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 1 costs, 1 mixed.

Residential care residents assign property for costs

Beginning October 1, 2026, residents receiving care in qualifying facilities are treated as assigning property interests to Louisiana's health department. This applies to licensed, state-run, 24-hour residential facilities provided by or through the department. Property interests include shares in trusts and estates. The assignment cannot exceed the cost of services actually provided. Assets federal rules allow residents to keep while staying eligible for Medicaid are exempt.

New oversight and expanded state care options

Beginning October 1, 2026, Louisiana's health department has a new Office of State Health Care Facilities. It oversees Eastern Louisiana Mental Health System, Central Louisiana State Hospital, Feliciana Forensic Facility, Villa Feliciana Medical Complex, Pinecrest Supports and Services Center, and Central Louisiana Supports and Services Center. Facility leaders report directly to its executive director, who reports directly to the department secretary; the office must follow state and federal requirements. The office can obtain licenses and certifications and operate additional inpatient, residential, outpatient, or day programs with legislative funding. The department can transfer existing funding and staff positions to establish the office, but the law sets no funding amount.

More treatment options, less local approval

Beginning October 1, 2026, the new office can combine psychiatric hospital administration and add independent or satellite inpatient or residential facilities. These settings must use funds the Legislature allocates to the state psychiatric hospitals. The health department can also establish forensic treatment facilities in New Orleans, Baton Rouge, Shreveport, Alexandria, and surrounding areas with legislative funding. State psychiatric hospital sites no longer need local governing authority approval, but state and local building and zoning rules still apply. The law sets no facility count or funding amount and does not guarantee new facilities.
