Bail backers get warrant notice protections

When a defendant misses court and an arrest warrant is issued, the clerk must send notice within 60 days of the missed appearance. Notice goes to the prosecutor, defendant, applicable bail agent or bondsman, and personal and commercial sureties—the bail backers. The defendant, agent or bondsman, and personal surety get notice by U.S. mail or electronically. Commercial sureties get electronic notice or certified mail with a return receipt requested. Agents or bondsmen who file an electronic-notice opt-in form must get electronic notice. Notices must use addresses provided under court rules or registered with the Department of Insurance. The commercial surety's notice must include the bail agreement's power of attorney number; omitting it does not invalidate a resulting judgment. The clerk must file a certificate confirming notice was sent. Failure to send notice within 60 days to the commercial surety and an opted-in agent or bondsman releases the surety from all bail agreement obligations.
