New paternity rules and protections for minors

Minors who are not legally emancipated cannot sign a paternity acknowledgment before age 16. At ages 16 or 17, they need court approval. They can request approval in a qualified court in the parish where they or the child have their legal home. The court can approve without other parties taking part, after considering the best interests of both the minor and child. It can require the minor to appear to check their understanding and whether they discussed acknowledgment with parents or a tutor. The court must ensure the minor knows about the right to seek blood or tissue testing before signing. If approval is denied, the minor can ask a court for legal emancipation.

Child support courts must consider minor parents

Louisiana courts must consider added factors when deciding whether to depart from standard child support amounts. These include a parent's status as a minor who is not legally emancipated. Courts must weigh the minor's limited ability to enter contracts, handle legal steps, and earn money. They must also consider available family or other support and the value of continuing the minor's education. Courts can consider any other reason standard amounts are unfair to the parties or against the child's best interests. These factors do not automatically reduce or change child support.
