Louisiana construction parties gain local dispute protections

For covered Louisiana construction projects, contracts cannot require another jurisdiction’s law to govern their interpretation. They also cannot require lawsuits or arbitration outside Louisiana when those actions are available under Louisiana law and procedures. These protections cover public and private projects when at least one party has its legal home in Louisiana. They apply to contracts, subcontracts, and purchase orders entered into on or after September 6, 1991. Covered work includes design, construction, changes, repairs, and maintenance of buildings, roads, bridges, utility lines, and other property improvements. It also includes moving, demolition, and excavation. Exclusions include dirt or gravel access roads to oil and gas wells, specified oil flow and gas gathering lines, and oil, gas, chemical, petrochemical, or fuel manufacturing facilities and related infrastructure. Deeds, leases, easements, licenses, and other agreements granting property rights are excluded, even when they allow construction. Negotiated labor contracts are also exempt.
