Five-year deadline for claims against construction professionals

The law sets a five-year deadline for covered damage claims involving planning, design, construction, demolition, and related services. It covers movable and immovable projects, including consultation, drawings, specifications, investigation, evaluation, measuring, and administration. Covered Louisiana professionals include engineers, surveyors, architects, landscape architects, interior designers, specified interns and agents, and similar licensees. The law also covers real estate developers for development plans certified by a professional engineer or architect. The clock generally starts when the owner's acceptance of the work is recorded in the mortgage office. If acceptance is not recorded within six months after occupancy or possession, the clock starts on the occupancy or possession date. For claims against providers whose services do not prepare for construction, the clock starts when their services end. That same starting point applies to providers who prepare for construction but do not inspect the work. The deadline limits claimants' access to damages and protects covered professionals and developers from claims after the period ends.
