Victims can speak before sentences are reduced

Louisiana trial courts must hold a hearing before granting motions to overturn otherwise final convictions or shorten imprisoned people’s sentences. Victims have the right to speak, and court clerks must send written notice about the motion and its impact. A designated family member takes the victim’s place if the victim has died or cannot appear because of a disability. Decisions granted without these steps can be set aside as clear legal errors. During an appeal, the court can send the case back on its own to consider the victim’s statement. The law applies going forward and does not create a right for individuals to join criminal cases as parties.
