Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 0 costs, 2 mixed.

School workers gain broader sick leave uses

Eligible Louisiana public-school teachers, bus operators, and covered employees can use existing sick leave for medical treatment, psychological treatment, and physical rehabilitation. The law does not add more leave days. At each school year's start, schools must give teachers and employees, including bus operators, written notice of their rights. The notice explains student discipline rights and sick and personal leave eligibility after injury from a student's assault or battery.

School hiring protections limit legal claims

Louisiana public school boards, nonpublic schools, and school systems gain protection from negligent-hiring claims for specified credentialed hires. Covered jobs are administrators, teachers, substitute teachers, athletic directors, coaches, and assistant coaches. The hired person must hold a valid teaching certificate or authorization from Louisiana's Board of Elementary and Secondary Education. Negligent-hiring laws and rules do not apply to claims arising from those hires, limiting legal options for people bringing claims.

School staff protection brings stricter student discipline

Principals must immediately suspend students formally accused of assaulting or battering school employees, remove them, or bar their return. This protection includes substitute teachers, substitute bus operators, and volunteers. Off-campus incidents qualify only when they continue a documented altercation that began on school property. Required notices and procedures must follow as soon as practicable. After a guilty finding in court or a school suspension hearing, principals must immediately recommend expulsion. Superintendents must expel students for at least two full school semesters, provide alternative schooling, and require anger management. Expelled students cannot attend their assigned school or the victim's assigned school; state and federal special-education protections still apply. Schools must keep incident, discipline, placement, and program records in the student's records.
