New insurance fund for Ascension clerk retirees

The law creates an insurance premium fund for eligible retired Ascension Parish clerks of court and deputy clerks. The clerk can contribute money but is not required to contribute a set amount. The clerk can withdraw investment earnings only after the fund’s principal and accumulated earnings reach $5 million. Those withdrawals can pay only eligible retirees’ insurance premiums, the fund board’s legal costs, or both. If deposits plus earnings fall below $4 million, earnings withdrawals stop. The clerk’s general fund must then pay any remaining balance owed for those costs in full. Investments follow the advisory board’s recommendation, with at least 25% in stocks and at least 25% in fixed-income investments. At least 75% of the fixed-income portion must be rated investment grade by a nationally recognized rating agency. The clerk appoints three board members: the clerk or a designee, one retired clerk or deputy, and one active deputy. The clerk sets their terms. The board recommends investments and elects a chair at its first meeting, held within 30 days after appointment. The clerk’s office audit must specifically check compliance with the fund’s rules.
