New portable benefit accounts for contractors

Louisiana law creates voluntary benefit accounts owned by independent contractors, assigned to individual beneficiaries, and not tied to one hiring party. Anyone, including app-based businesses, can contribute; hiring parties can use their own money. Withholding pay requires both parties’ express written agreement, clear and prominent terms in a services agreement or separate notice, and the contractor’s opt-in. Contractors can stop withholding at any time. Accounts can fund health, income replacement, disability, and life insurance, plus retirement benefits. Administrators can be banks, investment firms, or technology providers working through either. The hiring-party rules cover contractors who meet Louisiana’s rebuttable presumption standard for independent contractor status.

Contractor benefit payments cannot prove employment

Voluntary account contributions cannot determine worker classification or serve as evidence of employer liability. Courts cannot treat them as evidence of an employment relationship under Louisiana workers’ compensation or employment security law. This protects hiring parties but limits contractors’ use of those payments in employment disputes. The rule does not itself decide whether a worker is an employee or contractor. The act otherwise does not apply to workers’ compensation law and does not change its requirements or benefits.
