2 provisions identified: 0 benefits, 2 costs, 0 mixed.
Louisiana state and local agencies must make every reasonable effort to check benefit applicants' citizenship or qualifying immigration status, unless federal law bars checks. Covered benefits include retirement, welfare, health, disability, public or assisted housing, food, unemployment, and similar federal, state, or local aid. Agencies must stop recurring benefits when the reasonable time allowed to verify citizenship ends. They must also stop them when final checks find noncitizenship or no qualifying immigration status, plus entry without inspection or an overstay. For public pensions and retirement plans, a status check at enrollment satisfies the requirement.
Louisiana state and local agencies must send applicant information to U.S. Immigration and Customs Enforcement when the reasonable verification period ends. Referrals are also required when final checks find noncitizenship or no qualifying immigration status, plus entry without inspection or an overstay. Agencies must send monthly compilations to Louisiana's secretary of state for voter-list maintenance. Agencies administering federal or state benefits must report verification results at each fiscal year's end, including referral and benefit-termination counts. Reports go to the Senate president, House speaker, governor, and David R. Poynter Legislative Research Library.
