Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Faster court review for conviction challenges

Louisiana district courts must speed up review and decisions on previously unraised claims filed through this new process. If any party seeks Louisiana Supreme Court review through its supervisory authority, that court must give the claim priority. It must also speed up its review. The law sets no specific deadline for either court to decide.

New filing rules for conviction challenges

The law sets rules for conviction challenges raised in federal habeas petitions but not previously raised in state court. When a federal court pauses the case to allow state review, petitioners must file within 30 days after that pause. They must file in the Louisiana state district court for the parish where they were convicted. They must show good cause for leaving the claim out of earlier applications and that it is not plainly without merit. They must also show they have not intentionally used tactics to delay the case. The court must dismiss the application if any requirement is unmet. Existing application rules in Code of Criminal Procedure Articles 926 and 927.1 also apply.
