Analyzed Economic Effects

3 provisions identified: 3 benefits, 0 costs, 0 mixed.

Parishes can cut business inventory taxes

Louisiana parishes can remove all business inventory property taxes immediately or phase out those taxes over five years or less. They can instead cut the share of inventory’s fair market value used to calculate taxes. Qualifying inventory includes goods held for sale, goods being produced, and property intended for production. The sheriff, school board, and parish governing authority must jointly choose an option in writing. Partial reductions cannot be reversed, exceed constitutional percentages, or occur more than once per assessment period. Officials must state the reduced percentage and start date, then notify the Louisiana Tax Commission and assessor within 10 calendar days. The commission must include these notices in its annual report. The act covers property tax years beginning in 2026, but its exemption language specifies taxable periods beginning January 1, 2027. These rules operate only after voters approve the constitutional amendment in 2025 House Bill 366 and it takes effect.

Taxpayers protected from inventory tax shifts

Local taxing authorities must absorb revenue losses caused by the law’s inventory tax exemptions or reduced taxable values. They cannot pass those losses to other taxpayers through later property reappraisals, valuation changes, or property tax rate adjustments. Exempt inventory stays outside the taxable property base for later reappraisals and rate adjustments, and the relief cannot trigger them. The act applies to property tax years beginning in 2026. These protections operate only after voters approve the constitutional amendment in 2025 House Bill 366 and it takes effect.

State payments help parishes replace taxes

Beginning January 1, 2027, qualifying parishes receive one-time payments from Louisiana’s Revenue Stabilization Trust Fund. Parishes must irrevocably choose a full inventory tax exemption before July 1, 2027, immediately or within five years. Immediate exemptions bring three times the parish’s 2026 inventory property taxes collected, with a $1 million minimum and $15 million cap. Phased exemptions bring the parish’s 2026 inventory property taxes collected, with a $500,000 minimum and $10 million cap. Partial exemptions and full exemptions chosen on or after July 1, 2027, receive no payment. The treasurer must pay within 30 days after the Department of Revenue certifies the parish’s irrevocable choice. Parish tax collectors must divide payments proportionally among the parish’s taxing authorities. Payments operate only after voters approve the constitutional amendment in 2025 House Bill 366 and it takes effect.
