Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 2 costs, 0 mixed.

Public nicotine listings include exempt products

Louisiana’s Office of Alcohol and Tobacco Control must post a public online directory of covered manufacturers and products with compliant certifications. The state must correct errors and add or remove listings as needed. Each month, it must send registered or qualified dealers and manufacturers electronic updates, or post changes prominently online. Manufacturers can also request listings for products temporarily exempted from federal application requirements by an FDA rule, guidance, or formal statement. They must provide evidence that the product qualifies for the exemption and follows that federal statement.

Nicotine makers face certification and fees

Manufacturers must certify under penalty of perjury that products sold in Louisiana, directly or through dealers, meet federal-status rules. Products need FDA marketing authorization or an application that remains under review or meets the law’s stay, injunction, or appeal conditions. The application route requires vapor products on the U.S. market by August 8, 2016, with applications filed by September 9, 2020; alternative nicotine products have deadlines of April 14, 2022, and May 14, 2022, respectively. Manufacturers must submit application cover pages and proof of FDA receipt, or authorization cover pages, and report material changes within 30 days. They pay $100 per product stock keeping unit (SKU) initially and $100 per SKU each year; fees fund certification processing and the directory.

Nicotine sellers face unlisted product penalties

Once the directory is public online, manufacturers offering unlisted products for sale face a $1,000 daily fine per product. Fines continue until the product is listed or removed from the market. Wholesale and retail dealers selling, possessing, or transporting unlisted products face enforcement as though they lack valid permits. Each unit sold, offered for sale, possessed, or transported counts as a separate violation. Violations of the directory rules not covered by these penalties carry a $500 fine per offense.
