Louisiana claimants face new limits on compensation

Beginning January 1, 2026, Louisiana bars compensation if your negligence accounts for 51% or more of the fault. This applies when your negligence and another person's fault both cause an injury, death, or loss. Below 51%, your compensation is reduced by your share of fault. Fault must be assigned to everyone responsible, even people outside the lawsuit or whose identity is unknown. This includes people unable to pay or protected by law from liability. When a jury decides comparative fault, it must be told how these rules affect compensation.
