New hearing notice rules for alcohol businesses

Louisiana's Alcohol and Tobacco Control commissioner must schedule covered hearings at least 10 calendar days after the notice date. The law removes the former 30-day maximum, allowing later hearings. Notices must give the hearing's date, time and place, and reasons for denying an application or suspending or revoking a permit. Any filed petition opposing a permit or seeking its suspension or revocation must accompany the notice. Notices can be delivered in person, electronically to the permit holder's chosen address, or by certified mail. Certified mail sent to the address on the latest application is conclusively treated as received. Electronic service counts when sent, unless the commissioner knows it did not reach the chosen address. Hearings under R.S. 26:919(A) can also determine whether to assess a penalty.
