The law requires Louisiana health plans with maternity benefits and Medicaid to cover amino acid-based elemental formula. Coverage applies to children age two or younger, regardless of how they receive the formula. A board-certified allergist or gastroenterologist must diagnose a qualifying condition, and the treating doctor must provide a written medical-necessity order. Qualifying conditions are IgE- or non-IgE-mediated allergies to multiple food proteins; severe food protein-induced enterocolitis syndrome; eosinophilic disorders confirmed by biopsy; or poor nutrient absorption from disorders affecting the digestive tract’s absorptive surface, functional length, and movement. Coverage must be no less favorable than prescription-drug coverage, including through Medicaid managed care. Usual plan deductibles, coinsurance, and copayments may still apply; Medicaid cost-sharing may also apply. An insurer’s utilization reviewer can review the doctor’s medical-necessity decision. These rules take effect when a law containing a specific implementation appropriation takes effect. New policies, contracts, and plans must comply beginning January 1 immediately after that effective date. Existing coverage must comply by renewal or before the 359th day after that January 1.
