In Louisiana, each user can make no more than $3,000 in virtual currency kiosk transactions per day.
Louisiana kiosk operators must either wait 72 hours before processing transactions or offer cancellation and full refunds within 72 hours afterward, at their own cost—not both protections. Each kiosk must display a clear English warning in at least 20-point print: government officials do not request crypto ATM cash deposits, and suspected victims should contact local police before depositing. Operators must use blockchain software to help prevent transfers to wallets known to be linked to fraud; the state commissioner can request proof of use. Operators must take reasonable steps to prevent fraud and keep written policies covering risk checks, safeguards, monitoring duties, and regular review and updates. They must also enforce a written policy identifying users at risk because of age or mental capacity, reviewed and approved by their board or equivalent governing body.
Louisiana brings kiosk-related businesses under its virtual currency business rules, including licensing requirements. This covers anyone who owns, operates, solicits, markets, advertises, or facilitates a virtual currency kiosk. Covered kiosks exchange virtual currency for government-issued money or other virtual currency.
