Bill Overview

Analyzed Economic Effects

4 provisions identified: 2 benefits, 0 costs, 2 mixed.

Staff protected during registrar removal cases

A registrar facing removal cannot remove deputy registrars, confidential assistants, or other employees during the case. This protection starts when the registrar learns of the removal proceeding. It ends when the State Board of Election Supervisors makes its final decision. Registrars otherwise retain their authority to remove employees.

Registrar offices keep hours and answer locally

Principal registrar offices must open on days state departments are open, at least from 8:00 a.m. to 4:30 p.m. Registrars can extend office hours or days. Closures on state workdays are allowed only in extreme circumstances, and essential duties must continue. Registrars must also appear before their parish governing authority when it requests an appearance.

Merit reviews shape election staff pay

Louisiana registrars, chief deputies, and confidential assistants paid at salary step one or higher must receive annual January merit reviews. Ratings are “excellent,” “successful,” “unsuccessful,” or “not assessed.” An “excellent” rating earns the next salary step, up to the highest step allowed for the parish’s population range. The secretary of state sets registrar review rules with the Registrars of Voters Association and conducts reviews through designated evaluators. The association sets staff review rules, and parish registrars evaluate their staff. Registrars can appeal ratings to the State Board of Election Supervisors; members involved in the review cannot hear that appeal.

Registrars face suspension and removal rules

Louisiana’s State Board of Election Supervisors can remove registrars for willful duty-related misconduct or willful, persistent failure to perform duties. Other grounds include persistent public conduct that harms voter registration administration and discredits the office, incompetence, or consistent under-performance. Abuse of state leave policies, substance abuse policy violations, two successive “unsuccessful” annual ratings, and felony convictions also qualify. By majority vote, the board can immediately suspend a registrar, with or without pay, pending a removal hearing. Parish accusations require a two-thirds governing-authority vote and certified mail to the board chair, with return receipt requested. The board must schedule a hearing within 30 days of receiving that resolution or qualifying commissioner accusations. Commissioner accusations must concern the first seven grounds, rather than the rating or felony grounds. A commissioner serving on the board cannot hear the case; the secretary of state names an association member as replacement.
