Private victim testimony, new penalties for sharing

At Louisiana pardon hearings, victims—or a deceased victim’s spouse or next of kin—can request a private session for testimony. This includes testimony responding to evidence or testimony offered by or for the offender. The law makes knowingly and intentionally obtaining and electronically sharing recordings of covered private victim testimony a crime. This covers audio, written, and visual recordings from Board of Pardons and parole committee sessions. Penalties include a fine up to $500, up to six months in jail, or both; contempt penalties may also apply. Defendants, their lawyers or legal representatives, victims, qualifying relatives, victims’ legal guardians, and others authorized by law can request and obtain copies. Sharing allowed by law remains permitted.
