Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 1 costs, 0 mixed.

Lower Court Cost Cap for Nonsupport Defendants

The law lowers a separate criminal nonsupport court-cost cap from $15 to $10 in East Baton Rouge Parish Juvenile Court. This covers criminal nonsupport cases within the court's authority, including covered contempt proceedings. Defendants owe the charge after conviction at trial, a guilty plea, or bond forfeiture. The charge is in addition to all other fines, costs, and forfeitures. The money goes to the clerk for the court's judicial expense fund.

Higher East Baton Rouge Juvenile Filing Fees

The law raises the maximum filing fee for East Baton Rouge Parish Juvenile Court from $15 to $45. It covers actions, suits, motions, and rules to show cause. The court's judges jointly set the actual fee, which the Nineteenth Judicial District clerk collects. People exempt from court costs do not pay; court rules for people unable to afford costs still apply. The clerk places these fees and the criminal nonsupport charges in a separate judicial expense fund controlled by the judges. The fund supplements other court money and can support court operations and individual judges' offices, but cannot pay judges' salaries. Judges can hire staff and pay their salaries, and fund a law library, equipment, supplies, and related items. Court reporters can receive extra salary from the fund in place of some or all testimony reporting and transcription fees. Judges must arrange an annual audit of the fund and related books and accounts. They must file it with the Legislative Auditor, where the public can inspect it.
