Airport access rules for aerial applicators

Louisiana local governments cannot discriminate against licensed aerial applicators using their public airports or landing fields to apply seeds, fertilizers, or pesticides. Applicators must follow safety and airport-area protection rules from the airport owner, operator, or Louisiana Department of Transportation and Development. Applicators licensed by the Louisiana Department of Agriculture and Forestry must operate a working transponder and have a working two-way radio. These equipment rules apply only during aircraft operations connected with public-airport takeoffs or landings, including operations involving airport priority programs. Transponders must meet applicable federal rules, including ADS-B Out under 14 CFR 91.225 or Mode C under 14 CFR 91.215. Radios must communicate with airport traffic or advisory services when available. At public airports without an operating control tower, applicators must follow the Federal Aviation Administration's recommended standard traffic pattern. Exceptions cover safety needs, wind, runway layout, aircraft performance, or guidance from air traffic control or the Federal Aviation Administration. When an airport authority objects, the department's agricultural and environmental sciences office can inspect and monitor the field upon request before, during, and after application for harmful chemicals or residues. The agriculture commissioner can suspend an applicator's airport or landing-strip use after finding a violation.
