Bill Overview

Analyzed Economic Effects

3 provisions identified: 3 benefits, 0 costs, 0 mixed.

Clearer agency roles in insurance crimes

Louisiana’s Office of Insurance Fraud must refer possible crimes found during investigations to appropriate law enforcement agencies or prosecutors. The office can help investigate only with the receiving agency’s consent. Only proper law enforcement agencies and prosecutors handle criminal investigation, enforcement, or prosecution under these insurance-fraud provisions, including automobile insurance. Another law can provide an exception.

Clearer enforcement against unfair insurance practices

When Louisiana’s insurance commissioner suspects a licensed person of unfair insurance practices, the commissioner must send a notice. It must describe the conduct and cite the law believed to be violated. For suspected unfair practices by unlicensed people doing insurance business in Louisiana, the commissioner can order them to stop or impose fines. The commissioner can also take other action allowed by law, and affected unlicensed people can appeal. The commissioner can adopt rules allowing electronic delivery of notices.

Broader protections against unfair insurance practices

Louisiana’s unfair-practice rules cover selling, advertising, or seeking buyers for insurance policies. They also cover claim or benefit assistance on behalf of insurers, insured people, claimants, or their representatives, directly or indirectly. Lawyers actively providing legal services are excluded. Health providers and their representatives are excluded when helping patients with prior authorization or appeals over denied services from licensed providers. The ban on unfair or deceptive insurance practices is no longer limited to conduct in Louisiana. It includes unauthorized insurance and failure to carry professional liability insurance when required by law.
