Carbon injury claimants can seek higher damages

Louisiana removes limits on damages for pain, suffering, and other noneconomic harm in carbon dioxide lawsuits. This covers claims against storage facility or transmission pipeline owners or operators, and carbon dioxide generators. The former caps were $250,000 per person generally and $500,000 for specified severe injuries or wrongful death. A $1 million fallback cap applied if the main caps were invalidated. The law sets no replacement cap, so claimants can seek amounts above those former limits.
