Bill Overview

Analyzed Economic Effects

3 provisions identified: 0 benefits, 1 costs, 2 mixed.

Homeowners gain coverage choices with risks

Louisiana insurers can offer stated-value home insurance when you or your authorized agent requests it. You and the insurer agree on coverage that does not have to equal the cost to rebuild. Before issuing the policy, the insurer must get a statement signed by the insured homeowners. It must include a bold warning in at least 18-point type explaining coverage below rebuilding cost. The warning explains that a total loss or repairs exceeding coverage can cause major losses, including some or all home equity.

Fewer insurance notices reach homeowners

Insurers no longer must prominently disclose stated-value policy options in policy proposals, agreements, or renewal papers. The insurance commissioner no longer must send homeowners information about these policies at least once every two years. That requirement covered direct mail, email, or other delivery methods. The information remains available in a dedicated section of the Louisiana Insurance Department's website.

Home debt sets coverage and paperwork rules

If you choose stated-value insurance and your property has a mortgage or lien, you must submit written payoff statements. Each mortgage or lien holder must provide a statement showing the outstanding balance or describing the mortgage or lien. You must submit these statements when applying or renewing. Insurers cannot issue coverage below the verified total balance of all mortgages and liens on your property. This minimum does not guarantee enough coverage to rebuild.
