More sellers face off-road vehicle rules
Louisiana's all-terrain vehicle rules cover golf carts and qualifying off-road recreational and sports vehicles. Covered vehicles have a manufacturer's statement of origin and cannot get public-road registration because they lacked required safety features when made. Farm-use off-road vehicles, farm equipment, electric-assisted bicycles, and heavy construction equipment remain excluded. Anyone selling, offering, or distributing covered vehicles at retail counts as a dealer, even when vehicle sales are not their main business. The dealer definition also includes those licensed under the chapter to sell motor vehicles, specialty vehicles, or recreational products.
Buyers get notices but limited recourse
Louisiana all-terrain vehicle and golf cart dealers must give written notice before any sale or financing agreement when warranty service mainly uses a remote facility under contract with another entity. The notice must give the facility's name, physical address, approximate distance from the dealership, and a warning that repairs may require vehicle transport. Buyers must acknowledge the notice in writing before the sale is completed. Dealers must keep that acknowledgment for three years or until the warranty expires, whichever is shorter. Dealers are not liable for later changes in the disclosed provider's availability, location, authorization, ownership, or operations if they acted in good faith and gave accurate information at sale.
Dealers must provide vehicle repair options
Louisiana dealers must show adequate showroom, repair, and parts-storage space; license applicants must provide evidence of required facilities. Repair facilities must reasonably support warranty service, maintenance, and repairs for the recreational products sold. All-terrain vehicle and golf cart dealers can keep repair and new-parts storage facilities at their business or within 1,000 feet. Alternatives include a qualified warranty provider in Louisiana within 40 miles, a manufacturer agreement giving buyers access to authorized service, or being a manufacturer-authorized provider. Dealers using third-party or manufacturer agreements must make warranty information available to buyers; failure to meet servicing requirements is an enforceable violation.
