Fishing guide violations bring fines and tracking

Violations of the charter fishing guide rules carry Class Four penalties, except violations of the landing-report requirements. A first offense requires a fine of at least $1,000 paid to the Department of Wildlife and Fisheries. After a second conviction, offenders can operate only vessels with approved vessel monitoring systems for three years. After a third or later conviction, that restriction lasts ten years. Offenders pay for monitoring, must allow department access, and must identify vessels they will operate for commercial or recreational use. Guides, including people posing as guides, who operate without required approved monitoring face possible license suspension and a license ban for the rest of the year. They must also perform at least 40 hours of community service, preferably through an available litter cleanup program. The department must adopt rules to carry out these penalties.

New $100 access permit for fishing guides

Licensed Louisiana charter fishing guides can buy a $100 permit covering wildlife management area access for themselves and their clients. Coverage applies during for-hire fishing trips and runs from January 1 through December 31 of the calendar year. Guides must also submit landing reports to the Department of Wildlife and Fisheries as directed by the state wildlife commission. Reports may include trip counts, angler counts, areas and times fished, trip origins, and information needed for fishery management and stock assessments. Reports cannot include financial information, and submitted information must remain confidential under state law. The commission can adopt rules to carry out these requirements.
