Better drug cost-sharing for Louisiana patients
Louisiana-regulated health insurers must give qualifying generics and biosimilars better cost-sharing than their reference drugs. On its first marketing date, the approved generic or licensed biosimilar must have a lower wholesale price than its reference drug and all competing drugs sharing that reference. The insurer must also cover the reference drug on that date. It must immediately add the qualifying generic, or at least one qualifying biosimilar, to a better cost-sharing tier. Prior approval, step therapy, other coverage limits, and pharmacy rules cannot make access harder than for the reference drug. These protections last while the generic or biosimilar's wholesale price stays below the reference drug's price.
Insurers report costs but keep data private
Insurers may use net cost instead of wholesale price to decide a drug's place on their covered-drug list. For branded drugs, they must notify Louisiana's insurance commissioner in writing within 30 days of choosing net cost. For each affected national drug code, they must report wholesale price, net cost, and actual patient cost-sharing for the brand and any generic or biosimilar on a better tier. They must also explain how manufacturer rebates affect patient cost-sharing. The commissioner must report annually on these notices and their effect on patient costs. Nonpublic information stays confidential and exempt from public-record disclosure; outside parties with access must follow the same protections.
