2 provisions identified: 0 benefits, 1 costs, 1 mixed.

Higher fines for insurance service providers

Louisiana raises calendar-year fine caps for insurance producers, claims adjusters, insurance consultants, and covered lessors from $10,000 to $100,000. For producers and consultants, the cap applies per applicant or license holder. Fines remain capped at $500 per violation, except another insurance law can authorize higher penalties for claims adjusters. Producer, adjuster, and consultant penalties require a legal ground for discipline; lessor penalties cover violations under the lessor rule. The commissioner can combine fines with allowed licensing actions, including probation, suspension, revocation, or refusal to issue or renew licenses. These higher fine limits do not directly change household insurance costs or benefits.

Higher insurer fines with required hearing safeguards

Louisiana raises the calendar-year fine cap for insurers, health insurers, and limited insurance license holders from $100,000 to $1 million. The general cap also covers other people and entities subject to the rule. Fines remain capped at $1,000 per violation and depend on violations that warrant enforcement. The law requires formal hearings and a finding that penalties are warranted before they are imposed. The commissioner retains license suspension, revocation, nonrenewal, stop-order, and other enforcement powers; fines can replace licensing penalties under specified provisions. The commissioner can suspend or withhold fines where authorized, and the law does not directly change household premiums or benefits.
