Louisiana law expands first-degree rape to cover cases where the offender’s overpowering force prevents the victim from resisting. For third-degree rape, prosecutors have ten years to begin prosecution, starting when the victim discovers the crime. Longer periods under Articles 571.1 and 572(B), or another applicable law, still apply. The law also adds a standard charging form for forcible or second-degree rape.
Louisiana law repeals the separate oral sexual battery offense in R.S. 14:43.3. It also changes the allowed verdicts for first-degree rape charges, except cases involving victims under 13. The list includes first-, second-, and third-degree rape, attempts to commit each, and not guilty. Sexual battery and attempted sexual battery replace oral sexual battery as verdict options.
