Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Cosmetic businesses face fewer state requirements

Louisiana removes cosmetics from its annual product registration rule and related requirements to provide samples on request. Facilities selling cosmetics directly to consumers also avoid the state facility permits and inspections covered by this law. Direct-sale facilities still must follow federal cosmetics law and applicable state and local sales and use tax rules, including registration.

Home cosmetic businesses get limited exemptions

Qualifying home cosmetic businesses avoid state cosmetic permits, fees, and routine or periodic inspections. They must make, pack, or hold cosmetics for distribution from a private Louisiana residence. Annual wholesale cosmetic sales cannot exceed $100,000 per calendar year. The exemption excludes makers of products touching the eye’s mucus membrane, injected products, or products intended for internal use. It also excludes products meant to change appearance for more than 24 hours under normal use. Cottage facilities cannot make products claiming to diagnose, cure, reduce, treat, or prevent disease, or affect body structure or function. They must register and collect applicable local sales and use taxes, with a current sales tax certificate for each parish where sales occur. Federal cosmetics law still applies, including the Modernization of Cosmetics Regulation Act of 2022 and later regulations.
