New insurance rules for energy businesses

The law sets rules for coverage added to another party’s insurance in oil, gas, water, and mineral operations. A business seeking this coverage must separately request a premium quote in writing from the policyholder, insurer, or broker. It must receive the insurer’s or authorized representative’s quote and pay that insurer or representative directly. Group coverage is enforceable only when the premium is quoted and paid for the group. The added insured pays applicable deductibles or retained costs up to $100,000; the original policyholder pays amounts above $100,000. A contract requiring the original policyholder to pay any of the first $100,000 is unenforceable. The deductible allocation rule does not apply to that agreement. The policyholder, insurer, or authorized representative must give written renewal notice by the earlier of two deadlines: at least 30 days before the next annual premium is due, or within 7 days after renewal is bound. No advance notice is required if the added insured failed to request or pay for coverage in the prior policy year. That party must make a new written request. Buying coverage does not override the ban on contractual defense or indemnity for a party’s own negligence or strict liability. Contracts signed before the law’s effective date for a single, specific, terminable job are exempt.
