Dealer groups gain rights to sue

Qualifying dealer trade groups can bring or join cases in their own name or for their members. Cases can go before the Louisiana Motor Vehicle Commission or a district court with authority to hear them. Groups must be made up mainly of, and controlled by, at least 100 licensed motor vehicle dealers. At least one member must hold a valid license under the commission law and have an individual right to sue or join. The interests protected must fit the group’s purpose, and neither the claim nor requested relief can require individual members’ participation. Winning groups may receive rulings on legal rights, orders requiring or stopping actions, and reasonable costs and attorney fees. The law took effect upon the governor’s signature.
