Beginning August 1, 2026, required probation programs for first- and second-offense impaired driving must screen for substance use disorder risk. Court-approved substance abuse programs must use an evidence-based screening tool tested and validated for people who drive impaired. Results are confidential and go directly to the court, prosecutor, and defense lawyer. If screening shows risk, the court may—but need not—order an assessment by a licensed clinician. The court can adjust the program to fit the person's needs shown by that assessment. First offenses carry a $300–$1,000 fine and 10 days to 6 months in jail. Suspending that sentence requires probation and completion of the required program and other minimum conditions. Second offenses carry a $750–$1,000 fine and 30 days to 6 months in jail. At least 48 hours must be served without parole, probation, or a suspended sentence. Suspending the remaining sentence requires probation with the same minimum conditions, including the screening program.
